T-Mobile Loses Right To Waive Lawsuits For Arbitration

Wednesday, May 28th 2008 -- T-Mobile may state in their wireless contracts that issues with the company will go to artibration rather than to the court room, however the courts ruled today that such preventative measures are not permissable.

Currently T-Mobile offers a provision in their contract which states the company has the right to waive lawsuits againt the corporation in favor of an artibtrated setting, a move that the Supreme Court struck down, stating that the provision is unfair to customers.

The supreme court ruling will allow class action lawsuits against T-Mobile to move forward. Currently their is a clash between state and federal courts over whether such provisions should be allowed in contracts in general, the Supreme Court ruling is one of the first to address the issue and allow the provision to be dropped.
